First, there’s an epidemic of false convictions for sexual assault. It’s estimated 1 in 9 people serving time for sexual assault are innocent. This high rate of false convictions undermines the legitimacy of all convictions and is devastating to those who are unjustly convicted.
Second, not having a gradient of charges for sexual assault cases, like we do for murder cases, ignores the fact that not all cases are the same. This one-rule-fits-all limits judges discourages reporting, inadequately addresses the justice needs of survivors, forces jurors to choose between an absence of punishment and extreme sentences, and perpetuates public misperceptions and stigmas.
